5. Every person that is the owner or user of a name or trademark and has a domicile or establishment in Québec is required to develop, implement and contribute financially to a deposit-refund system for redeemable containers in which a product is commercialized, marketed or otherwise distributed in Québec under that name or trademark.
The obligations specified in the first paragraph apply to a person having a domicile or establishment in Québec who acts as the first supplier of the product in Québec, other than the manufacturer, if
(1)  the owner or user of the name or trademark has no domicile or establishment in Québec;
(2)  the product is commercialized, marketed or otherwise distributed in Québec without a name or trademark.

5.
